Welcome to Indigenous Jobs Canada (“we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the Indigenous Jobs Canada website, platform, and services (the “Platform”).

By accessing or using Indigenous Jobs Canada, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Platform.


1. About Indigenous Jobs Canada

Indigenous Jobs Canada is an online employment platform dedicated to connecting employers with Indigenous jobseekers, First Nations, Inuit, Métis communities, Indigenous organizations, and employers committed to Indigenous hiring across Canada.

The Platform enables employers, recruiters, Indigenous organizations, government agencies, staffing professionals, educational institutions, and other organizations to advertise employment opportunities while allowing Indigenous jobseekers to search and apply for jobs.

Indigenous Jobs Canada is a technology platform only. We do not act as an employer, recruiter, employment agency, Indigenous organization, immigration consultant, or government authority, and we do not guarantee interviews, hiring outcomes, employment, or regulatory approvals.


2. Eligibility

By using Indigenous Jobs Canada, you confirm that:

  • You are at least 16 years of age.
  • You have the legal capacity and authority to enter into these Terms.
  • All information you provide is accurate, complete, and up to date.

3. User Accounts

Certain features of the Platform require users to create an account.

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activities conducted under your account.
  • Keeping your account information accurate and current.

Indigenous Jobs Canada reserves the right to suspend, restrict, or terminate any account that violates these Terms or is used in a fraudulent, unlawful, or abusive manner.


4. Job Postings and Applications

Employers, Recruiters & Organizations

You are solely responsible for:

  • The accuracy, legality, and completeness of your job advertisements.
  • Ensuring your recruitment activities comply with applicable Canadian laws and regulations.
  • Responding appropriately to applicants.

Indigenous Jobs Canada does not verify, endorse, or guarantee the accuracy or legitimacy of any job posting.

Jobseekers

You are responsible for:

  • The accuracy of your resume, profile, and application information.
  • Verifying the legitimacy of employers before accepting employment.

Submitting an application does not guarantee an interview or employment.

Indigenous Jobs Canada is not responsible for hiring decisions, communications, negotiations, employment contracts, or disputes between users.


5. LMIA and Regulatory Disclaimer

Indigenous Jobs Canada may be used by employers and immigration professionals to advertise positions related to Labour Market Impact Assessment (LMIA) recruitment.

However:

  • Indigenous Jobs Canada does not guarantee LMIA approval.
  • LMIA decisions are made solely by Employment and Social Development Canada (ESDC).
  • Users are responsible for ensuring their recruitment activities comply with all applicable LMIA advertising requirements and government regulations.

LMIA rules, Indigenous employment initiatives, employment regulations, and government advertising requirements may change from time to time. It is solely the responsibility of employers, recruiters, Indigenous organizations, immigration consultants, staffing agencies, and other users to verify that their job advertisements comply with all current legal and regulatory requirements before publishing them on the Platform.

Indigenous Jobs Canada provides a technology platform for publishing job advertisements and does not review, verify, or guarantee compliance with LMIA requirements, Indigenous employment program requirements, or any other legal or regulatory obligations.


6. Prohibited Use

Users must not:

  • Publish false, misleading, deceptive, or fraudulent job advertisements.
  • Misrepresent wages, working conditions, job duties, or employer identity.
  • Post discriminatory, offensive, unlawful, or prohibited content.
  • Attempt to collect, scrape, or copy information from the Platform without authorization.
  • Attempt to interfere with the security, operation, or availability of the Platform.
  • Use the Platform for spam, phishing, malware, or unauthorized commercial activities.

Indigenous Jobs Canada reserves the right to remove content and suspend or terminate accounts without prior notice where violations occur.


7. Fees and Payments

Certain services and job advertising packages are provided for a fee.

  • Pricing is displayed on the Platform.
  • Payments are processed through secure third-party payment providers.
  • By completing a purchase, you authorize Indigenous Jobs Canada or its payment processor to charge the applicable amount.
  • Indigenous Jobs Canada reserves the right to modify pricing, packages, or features at any time without prior notice.

8. Refund & Return Policy

Purchases made through Indigenous Jobs Canada are subject to our Refund & Return Policy, which forms part of these Terms of Service.

Please review our Refund & Return Policy for complete information regarding:

  • Refund eligibility
  • Non-refundable purchases
  • Duplicate payments
  • Failed or incomplete transactions
  • Technical issues
  • LMIA-related limitations
  • Refund request procedures

By purchasing any job advertising package or related service, you acknowledge that you have read, understood, and agreed to the Refund & Return Policy.


9. Intellectual Property

All content, software, trademarks, logos, graphics, text, and other materials available on Indigenous Jobs Canada are owned by Indigenous Jobs Canada or its licensors and are protected by applicable intellectual property laws.

Users may not reproduce, copy, distribute, modify, publish, or exploit any content without prior written permission.


10. Third-Party Services

The Platform may contain links to third-party websites or services.

Indigenous Jobs Canada is not responsible for the content, privacy practices, availability, or services provided by third parties.


11. Limitation of Liability

To the maximum extent permitted by law:

  • Indigenous Jobs Canada provides the Platform on an “as is” and “as available” basis.
  • We make no warranties regarding uninterrupted availability, accuracy, reliability, or suitability.
  • Indigenous Jobs Canada is not liable for indirect, incidental, consequential, special, or punitive damages arising from use of the Platform.
  • Indigenous Jobs Canada does not guarantee job placements, interviews, employment offers, immigration outcomes, Indigenous hiring program eligibility, or regulatory approvals.

Use of the Platform is entirely at your own risk.


12. Indemnification

You agree to indemnify and hold harmless Indigenous Jobs Canada, its owners, directors, employees, affiliates, and service providers from any claims, damages, losses, liabilities, costs, or legal expenses arising from:

  • Your use of the Platform.
  • Your job advertisements or applications.
  • Your violation of these Terms.
  • Your violation of applicable laws or regulations.

13. Suspension and Termination

Indigenous Jobs Canada may suspend, restrict, or terminate access to the Platform at any time if users violate these Terms or engage in unlawful or abusive conduct.

Users may also delete or terminate their accounts at any time.


14. Changes to These Terms

Indigenous Jobs Canada may modify these Terms periodically.

Updated versions will be published on this page together with the revised Effective Date.

Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.


15. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.


16. Compliance With Canadian Employment and Job Advertising Regulations

Users are solely responsible for ensuring that all recruitment activities, job advertisements, employment offers, and related content comply with applicable federal, provincial, territorial, and Indigenous employment regulations in Canada, including any new or amended job advertising or employment requirements introduced from time to time.

Indigenous Jobs Canada provides a technology platform for publishing job advertisements and managing recruitment activities. Indigenous Jobs Canada does not review or guarantee legal compliance of user-generated content.

Users are responsible for:

  • Remaining informed about current employment and recruitment regulations.
  • Ensuring job advertisements satisfy applicable legal and regulatory requirements.
  • Obtaining independent legal or professional advice where appropriate.

Indigenous Jobs Canada shall not be liable for penalties, enforcement actions, financial losses, or other consequences resulting from a user’s failure to comply with applicable laws or regulations.
